1. Overview

These Terms of Service (“Terms”) govern your use of services provided by SWOONZ (“we”, “us”, “our”), including event design, installations, brand activations, and related services.

By booking or using our services, you agree to these Terms.

2. Services

SWOONZ provides customized event planning, styling, and installation services. All services are tailored to client requirements and may vary based on scope, availability, and location.

We reserve the right to modify or refuse service at our discretion.

3. Booking & Payments

A non-refundable advance payment is required to confirm any booking
Full or remaining payment must be completed before the event date
Failure to complete payment may result in cancellation of services

No booking is confirmed until payment is received.

4. Cancellations & Refunds

All cancellations and refunds are subject to our Refund & Cancellation Policy.

5. Client Responsibilities

The client agrees to:

Provide accurate event details (date, time, venue, requirements)
Ensure timely access to the venue for setup and breakdown
Obtain any required permissions from the venue
Ensure a safe working environment

SWOONZ is not responsible for delays or issues caused by inaccurate information or restricted access.

6. Changes to Services

Any changes requested after confirmation may incur additional charges
Last-minute changes are subject to availability and are not guaranteed

7. Setup & Liability

Once setup is completed, SWOONZ is not responsible for damage caused by guests, venue staff, or third parties
Clients are responsible for any damage to rented or installed items

8. Force Majeure

SWOONZ is not liable for failure or delay in performance due to events beyond our control, including but not limited to:

Weather conditions
Government restrictions
Venue-related issues
Transportation disruptions

9. Intellectual Property

All designs, concepts, visuals, and installations created by SWOONZ remain our intellectual property.

Clients may not copy, reproduce, or reuse our designs without prior written permission.

10. Photography & Marketing

We reserve the right to capture photos and videos of our work and use them for marketing purposes unless the client requests otherwise in writing.

11. Limitation of Liability

To the fullest extent permitted by law, SWOONZ shall not be liable for:

Indirect or incidental damages
Losses arising from event delays or cancellations beyond our control
Client dissatisfaction due to subjective expectations

12. Governing Law

These Terms shall be governed by the laws of the State of New York, United States.
